    Process

    Step 1 – Drafting of your Wills

    Your draft Will(s) shall be prepared within four (4) working days of the order.

    Step 2 – Review and amendments

    Once you receive the draft Will(s), you will need to review and confirm the draft(s). If you require any amendments, we will make the required amendments to ensure that the draft(s) are acceptable to you.

    Step 3 – Registration

    An appointment would be made with the DIFC to register your Will(s). Your Will(s) shall be registered with the DIFC Courts Wills Service Centre either through video call or through an in person meeting (at your choice).

    What are DIFC Wills?

    DIFC Wills are registered with the DIFC Courts Wills Service Centre established as part of DIFC Courts in the Emirate of Dubai, United Arab Emirates. These Wills are prepared in accordance with the Wills and Probate Registry Rules implemented by the DIFC Courts. The Rules are designed as per the principles of English Law which provide the testators complete freedom in choosing their beneficiaries and other aspects of their estate planning after death. This makes it easy for the non-Muslims to opt out of the application of Sharia Law which would otherwise apply in the absence of a duly registered Will in the UAE.

      DIFC Courts Wills Service Centre is a Wills registration office established as part of the DIFC Courts.

    • Asset Coverage

      All movable and immovable assets situated in the UAE are covered. Testators can also choose to cover assets in other countries around the world on a case by case basis subject to appropriate advice.

    • Registration

      Registration can either be done through video conferencing or by way of an in person meeting. The in person meeting can either be done at the DIFC Wills Service Centre or at the RAKICC Dubai offices.

    • Residency Requirements

      None. Any non-Muslim having either assets or family in the UAE can register a DIFC Will.

      AED 10,000 for a DIFC Single Will

    Typically, the second parent is appointed as the guardian of minor children. However, to cover a situation where both parents pass away together, it is recommended that at least two (2) alternate guardians are appointed in Will.
     
    An executor is a person who is appointed in the Will to act as an executor of the Will after the death of the deceased. The executor ensures that the named beneficiaries are given their entitlements towards the estate of the deceased.
     
    It is common for married individuals to appoint their spouses as primary executors in their Wills.  However, to cover a situation where both parents pass away together, it is recommended that at least two (2) alternate executors are appointed in Will.
     
    The timeframe for the probate of a DIFC Will after death is expected to be about 1-3 weeks.
     
    A DIFC Will is written and registered in English. It is registered at the DIFC Wills Service Centre. In contrast, a Dubai Court Will is bilingual (English and Arabic) and is notarised/registered before the Notary Public. The registration costs of these two Wills also vary.     Preparing a DIFC Will involves two(2) steps. The first step is drafting where your Will is written based on your requirements and circumstances. The second step is registration where you will sign the Will along with two (2) testators.
     
    As the testator of your Will, you can appoint your spouse, family member, or a friend as an executor. You must ensure that the individual you choose is trustworthy and reliable for being entrusted with the responsibility of executing your Will. Additionally, the executor must be over 21 years of age, and should have no past crime record.
